I, Mayor Graham Smith, give notice that at the next Meeting of Council be held on 16 November 2021, I intend to move the following motion:-

 

Motion

1.       That Angela Oosthuizen be appointed Acting Chief Executive of Mackenzie District Council while a formal recruitment process is undertaken.

 

Rationale

Chief Executive Suzette vanAswegen declined the councils’ offer to extend her employment agreement with the council for another two years, and her term of employed ended on Friday, November 12.

I commend this Notice of Motion to Council.

Purpose of Report

To purpose of this report is to provide Council with the relevant information to enable the adoption of the proposed Policies and Bylaws 2021.

 

Staff Recommendations

Background

The Council at its meeting on 29 June 2021 formally adopted the Policies and Bylaws Review – Statement of Proposal and the Proposed New Policies and Bylaws – Statement of Proposal for formal consultation pursuant to section 83 of the Local Government Act 2002 (LGA).

The Council also resolved in regard to class 4 gambling to endorse, as a preferred option, a modified sinking lid where there is an ability to transfer class 4 gaming machines where a business sells but should a business close for any other reason the machines will be non-transferable.

The Policies and Bylaws Review – Statement of Proposal addresses seven active policies and bylaws which are required to be reviewed pursuant to section 158 of the LGA:

·    The Solid Waste Bylaw 2013;

·    The Wastewater Network Bylaw 2014;

·    The Water Supply Bylaw 2014;

·    The Dog Control Policy and Dog Control Bylaw 2014;

·    The Market Place Liquor Ban Bylaw 2014;

·    The Class 4 Gambling Venue Policy and TAB Venue Policy 2016; and 

·    The Dangerous and Insanitary Buildings Policy 2005.

The Proposed New Policies and Bylaws – Statement of Proposal addresses current gaps in Council’s regulatory toolbox and proposes to introduce two new bylaws and one new policy related to the keeping of animals, poultry and bees, trading over the Easter holiday period and a General Bylaw.

The Statements of Proposal and associated Policies and Bylaws were released for formal consultation, in accordance with the Special Consultative Procedure set out in the LGA, on Tuesday 6 July 2021. The submission period closed on Friday 6 August 2021.

In total 15 submissions were received on the Proposed Policies and Bylaws 2021. A breakdown of the submissions received in relation to the Proposed Policies and Bylaws is provided in Table 1. It is noted that one submitter commented on three different policies and bylaws, within their individual submission, which accounts for the discrepancy between the total number of submissions received (15) and the number of submissions received in Table 1 (18).

Five submitters, in support of their submission, were heard at a public hearing held on Tuesday 14 September 2021. Following the close of the hearing the Council has considered each submission on its individual merits and has determined if they uphold the submission, uphold the submission in part or dismiss the submission.

 

DETERMINATIONS

 

Following the completion of the policies and bylaws hearing on 14 September 2021, a deliberations session was held on 5 October 2021 for elected members.

 

Based on the deliberations and having heard and received the submissions the Council have made the following determinations on the Policies and Bylaws 2021:

The Dog Control Policy and Dog Control Bylaw 2021

Section 4 (Obligations of Dog Owners) of the Proposed Dog Control Bylaw is amended to ensure the requirement for all dogs to be implemented with a microchip  does not apply to working dogs in accordance with the Dog Control Act 1996.

Submission Upheld –  It was never Council’s intension to require working dogs to be microchipped. The Dog  Control Bylaw shall therefore be amended to reflect the Proposed Dog Control Policy 2021 and Dog Control Act 1996.

Mr. Cowan

Section 4 (Obligations of Dog Owners) of the Proposed Dog Control Bylaw is amended to allow dogs to be restrained by electronic boundaries in addition to a fixed chain or running wire where a property is unfenced.

Submission Upheld – The Council do have some concerns with electronic boundaries. Some subdivisions in the district  however do not allow permanent fencing. Technology in this area is also evolving. The Dog Control Bylaw shall therefore be amended to allow for electronic boundaries in addition to a fixed chain or running wire.

 

Alcohol Restrictions in Public Places Bylaw 2021

The proposed alcohol restriction area in Tekapo should be extended to include the bund and foreshore area of Lake Tekapo near the Church of the Good Shepherd.

Submission Dismissed – Before making a bylaw for the purpose of prohibiting, or otherwise regulating or controlling the consumption and possession of alcohol the Council, under the LGA, must:

 

a)  be satisfied that it can be justified as a reasonable limitation on peoples rights and freedoms;

b)  that there is evidence that the area has experienced a high level of crime and disorder that can be shown to have been caused or made worse by alcohol consumption in the area; and

c)  The bylaw is appropriate and proportionate in light of the crime or disorder.

The proposed alcohol restriction area in Tekapo was created in consultation with the local Police who identified concerns around disorder resulting from the presence of alcohol in this area. The restriction area was also proposed as it is located in the main village center which services licensed premises and contains the  Tekapo Domain (public open space). While the sentiment of having an alcohol ban area around the church is valid there is no evidence that the area surrounding the church has experienced a high level of crime and disorder that has been caused or make worse by alcohol consumption.

 

It is noted that the Council will monitor the effectiveness of the bylaw and alcohol consumption in this area over the next three years to ensure alcohol consumption surrounding the Church is appropriately managed. The Council under the proposed Bylaw will also have the option to create a Temporary Alcohol Ban Area at peak times such as over the Christmas - New Year Holiday Period if required.

Mr. Bruin

There should be no alcohol restrictions in the district. Alcohol restrictions are a waste of time and money given the administration cost of implementing them. 

Submission Dismissed – The proposed sites have been created in consultation with the local Police who identified concerns around disorder resulting from the presence of alcohol in these public places.

 

Keeping of Animals Poultry and Bees Bylaw 2021

The cat management provisions should be extended to apply district wide (not just urban areas), the cat provisions should be strengthened to limit the number of cats per household rather than per person and that there is a requirement for cats to be micro-chipped and desexed over the age of six months rather than the proposed ‘strongly encourage.’

Submission Upheld in Part – The definition of owner shall be re-worded to include all adults residing permanently at an animals usual place of residence to ensure the number of cats per household is limited to two rather than per person. This will reflect the approach taken in the Dog Control Policy and Dog Control Bylaw 2021.

 

While feral cats are identified as a significant pest in rural areas the cat provisions shall not be extended to apply district wide. The proposed provisions are targeted at domestic cats only and are intended to protect the public from nuisance that can be caused by cats in accordance with the requirements of the LGA.

 

The Council will maintain the proposed wording of ‘strongly encouraged’ as there would be significant cost, resource and time required to enforce the Bylaw if microchipping and desexing became a formal requirement. Unlike dogs there is no legislation requiring cats to be microchipped and registered. There are therefore limited mechanisms for Council to regulate/control the keeping of cats with the only mechanism being prosecution through the courts.

Mr. Rob Young

The bylaw should be amended to allow for the keeping of bees in urban areas. Limitations on the siting and number of hives will ensure any effects are mitigated.

Submission Upheld –  The Council originally did not allow for keeping of bees in urban areas in accordance with the District Plan which does not allow for the keeping of bees or pigs in the Residential and Rural Residential 1 and 2 Zones.

 

Based on the submission from Mr. Young the Council acknowledge the positives of allowing for bees in urban areas and interpret the District Plan provisions to apply to commercial bee keeping rather than hobbyist beekeepers. Keeping of bees by hobbyist beekeepers in urban areas shall therefore be provided for in the bylaw subject to conditions. Most notably, the maximum number of hives per property shall be limited to two, a water source shall be provided and maintained on the property at all times and all apiary is to be registered under the Biosecurity (National American Foulbrood Pest Management Plan) Order 1998. 

Mackenzie Country Honey Limited

The bylaw should be amended to allow for the keeping of bees in urban areas provided all legal requirements under the Biosecurity Act 1993 are strictly adhered to. Properties larger than 800m2 shall have a maximum of two beehives and properties larger than 2,000m2 shall have up to five beehives.

Submission Upheld in Part – The Council acknowledge the positives of allowing for bees in urban areas and will amend the Bylaw to allow hobbyist beekeepers in urban areas. There will however be a limit of two hives per property.

Water Supply, Wastewater and Stormwater Bylaw 2021

Amendments should be made to Section 4.16, Section 8.1(e) and Section 8.2(a) as the Bylaw does not allow for permitted or consented activities under the Operative Mackenzie District Plan and to acknowledge the role of good practice in informing the provision and maintenance of treatment devices:

 

Section 4.16: No person shall allow for cause to be allowed inadvertently or otherwise the discharge of hazardous substances to a Network Infrastructure Service unless permitted by a consent provided for by a Bylaw approval, resource consent or a permitted activity rule.

 

Section 8.1(e): Council may require the provision and maintenance of any pre-treatment works as necessary to regulate the quality, quantity and rate of stormwater discharge, or other constituents or characteristics of the stormwater discharges, prior to the point of discharge. This will be guided by industry good practice documents where applicable, for instance the Environmental Guidelines for Water Discharges from Petroleum Industry Sites in New Zealand (Ministry for the Environment, 1998). The provision and maintenance of such pre-treatment works shall be at the customer's expense.

Section 8.2(a): contaminants, sewage or trade wastes in breach or contravention of an Bylaw approval, resource consent, or permitted activity rule to discharge stormwater; or

Submission Dismissed – The proposed changes relies on multiple pieces of legislation and would not provide Council with sufficient mechanisms to react to legislative changes that may occur. The bylaw and its impact will be monitored over time with any subsequent changes to be completed on an as needed basis.

Fire and Emergency New Zealand (FENZ)

Amendments should be made to Section 5.2, Section 5.4, and Section 5.6 of the Bylaw to provide for FENZ ongoing operations and to reference current legislation.

 

Section 5.2: The fire protection systems – including sprinkler systems, fire hose reals and hydrants is removed from the Extraordinary Supply category to the Ordinary Supply category.

         

Section 5.4: Any proposed connection for fire protection shall be subject to a separate application for supply on the approved form. Where a connection has been provided to supply water to a fire protection system (including hydrants), it shall be used for no other purpose other than firefighting and testing the fire protection system. Connections shall be designed in accordance wit the New Zealand Fire Service Firefighting Water Supplies Code of Practice SNZ PAS 45009:2008.

 

Section 5.6: The right to gain access to, and draw water from, fire hydrants shall be restricted to:

·    Council or its authorised agents; and

·    The New Zealand Fire Service Fire and Emergency New Zealand personnel.     

Submission Upheld – Councils Three Waters Manager Mr. Geoff Horler has no concerns with the recommendations from FENZ. The bylaw shall therefore be amended in accordance with their recommendations.

 

Easter Sunday Trading Policy 2021

Dangerous, Affected and Insanitary Buildings Policy 2021

Dangerous and insanitary buildings should not exist in the district.

Submission Upheld – The proposed Dangerous, Affected and Insanitary Buildings Policy 2021 will give Council the tools to effectively mange buildings that have become dangerous or insanity in the district. 

 

CLASS 4 GAMBLING AND TAB VENUE POLICY

The Council on 29 June 2021 resolved to revoke the Class 4 Gambling Venue Policy and TAB Venue Policy 2016 and replace them with a new Class 4 Gambling and TAB Venue Policy 2021. The Council proposed a number of options to the public to consider:

·    Option 1 – The Council impose a sinking lid

·    Option 2 – The Council lower the overall cap on the number of gaming machines in the district.

·    Option 3 – The Council impose no change or impose another option not listed.

The Councils preferred option was Option 3 (another option not listed) where the Council adopts a modified sinking lid where there is an ability to transfer gaming machines where a business sells but should a business close for any other reason the machines will be non-transferable (this includes relocation).

Five submissions were received on the Class 4 Gambling and TAB Venue Policy 2021. The submissions were received from Trust Aoraki Limited, the Problem Gambling Foundation of New Zealand, the Gaming Association of New Zealand, Community and Public Health and Mr. Chris Bruin. 

Trust Aoraki Limited and the Gaming Association of New Zealand support Option 2 which provides a cap of 45 machines and a suitable relocation policy. The Problem Gambling Foundation and Community and Public Health support the introduction of a strong sinking lid. Mr. Bruin does not believe in restrictions on gambling and believes they are a waste of time and money given the administration of implementing them.

The Council is required under legislation to have a policy on Class 4 and TAB Venues. Mr. Bruins submission can therefore be dismissed.

Based on the four remaining submissions received the Council must determine how they wish to manage class 4 gambling in the district. The options are:

·    The Council impose a strong sinking lid (supported by the Problem Gambling Foundation and Community and Public Health)

·    The Council lower the overall cap on the number of gaming machines in the district but allow class 4 gambling venues to be relocated and gaming machines to be transferred (supported by Trust Aoraki Limited and the Gaming Association of New Zealand).

·    The Council adopt the preferred option “a modified singing lid where there is an ability to transfer gaming machines where a business sells but should a business close for any other reason the machines will be non-transferable.” It is noted that electronic gambling machines are not owned by individual property owners but are managed by Trust Aoraki or possibly other providers, whom have an agreement with the business owner to have machines on their premise. This option would provide for the transfer of license between parties so long as the machines were staying within the same premise.

·    The Council adopt the preferred option but allow reinstatement of machines following closure caused by fire and/or natural hazards.

·    Council create an additional proposal not provided by staff within this report.

Policy Status

The Policies and Bylaws have been created under relevant legislation. This has included an engagement process in accordance with the requirements of the Local Government Act 2002 (LGA). Once adopted these will become statutory documents administered by the Mackenzie District Council in accordance with delegation manual.

Significance of Decision

The policies and bylaws have been through the Special Consultative Procedure set out in the LGA.

Options

Dog Control Policy and Dog Control Bylaw 2021

Option 1 – The Council uphold the submissions to the Dog Control Bylaw 2021, as detailed above, and adopt the Dog Control Policy 2021 as notified and the amended Dog Control Bylaw 2021 (attached) (Preferred Option).

Option 2 – The Council dismiss the submissions to the Dog Control Bylaw 2021 and adopt the Dog Control Policy and Dog Control Bylaw 2021 as notified.

Considerations

Legal

Adoption of the Policies and Bylaws will ensure Council meet their statutory responsibilities and will enable Council to deal with specific activities and issues appropriately using regulatory enforcement.

Financial

Additional regulatory staff to enforce the policies and bylaws may be required in future. The requirement for additional staff will be closely monitored once the policies and bylaws have been adopted.

Other

Several of Council’s current policies and bylaws will be revoked if they are not reviewed. The proposal will result in Policies and Bylaws continuing to have legal effect. Failure to review the current policies and bylaws will mean Council has limited ability to carry out important regulatory functions.

Conclusion

The policies and bylaws have been through the Special Consultative Procedure set out in the LGA and will give the Council an ability to effectively manage activities and issues in the district through regulatory enforcement.
